When can I make a claim?

Accidents can occur in every aspect of life from walking down the street to driving in a car to sustaining injury in the workplace. It is when an accident occurs which is due to the negligent actions or inactions of another party, or due to a breach of the law, that a claim may be pursued.

The accident must have occurred in England or Wales within the last 3 years.

Types of Accident/Injury

  1. Accidents at Work
  2. Accidents in Public Places
  3. Accidents on the Highway - Tripping and Slipping on Roads and Pavements
  4. Road Traffic Accidents
  5. Assaults

What can I claim compensation for?

Compensation is not a bonus or a prize or a windfall. It is the money to which you are entitled to put you back into the position you would have been in, had the accident not occurred. We will give careful consideration to what those losses are to ensure that the full extent is claimed on your behalf.

Compensation or ‘damages’ are broken down into two different headings — general and special damages.

General Damages

This refers to the pain, suffering and loss of amenity (the affect your injury has on your quality of life) and can only be accurately quantified by our instructing a medical expert to examine you and prepare a report.

For a broad indication of what the Courts will look to award for various types of injury, please refer to our compensation calculator.

Special Damages

In addition to compensation for your injuries, you are entitled to claim for the losses that arise from that injury known as Special Damages. Special Damages covers all items of calculable expense and loss such as loss of earnings, travel expenses, prescription charges, help with gardening, DIY, maintaining a motor car, painting and decorating.

For more on this subject and a practical guide on how to recover these items of loss see – How much is my claim worth?

Will it cost me anything?

No.

We will assess your claim and look to enter into a Conditional Fee Agreement with you, more commonly referred to as “No Win, No Fee”. For more information on funding of your claim visit our “No Win, No Fee Explained” page.

How much will I get?

You will receive 100% of the compensation we recover on your behalf. We strive to recover the maximum amount of compensation for your injuries and losses. Your legal fees will be paid by your opponent.

For a broad indication of what the Courts will look to award for various types of injury please visit the Compensation Calculator.

How long will it take?

It usually takes at least six months to complete a claim, although this may vary if you have not recovered from your injuries. Click here for a guide on the claims process.

Will I have to go to Court?

Probably not.

In 95% of cases you will not need to go to court. You will only need to attend if any liability is in dispute or we cannot agree the value of your claim.
