Cohabitation

When a relationship breaks down and the parties were not married or had not entered into a civil partnership often a dispute arises regarding ownership of the shared home whether owned in the joint names or in the sole name of one of the cohabitees.

If a property is owned by one party alone then disputes can arise as to what interest in the property the other party may have, and this is where the law of property and trusts will come in. This is a complex area of law and requires specialist legal advice which we are on hand to offer.

Any financial agreement upon separation between cohabitees can be drafted into a separation agreement. If it is not possible to agree then court proceedings can be issued, this is of course a last resort.
