Untraced Drivers
If you have been injured by a vehicle that does not stop, we will be able to submit a claim under the Untraced Drivers Agreement to the Motor Insurers Bureau (MIB).
Checklist
If you have had an accident involving an untraced driver, do the following:
- Get as many details as you can about the other driver. Vehicle registration number, contact details, make and model of the car. Obtain details of any witnesses.
- Report the accident to the police within 14 days if you are making a claim for injury or within 5 days if you are making a claim for damage
- Report your accident to your insurance company.

We can only work on a no win no fee basis if the Defendant is identified. If you are the victim of a driver who is untraced, we can still act for you but on this occasion we will agree to take a proportion of your damages to fund our costs. The reason for this is that the Motor Insurers Bureau will only pay a contribution towards our costs upon conclusion of the case. If, however, you do not win, we will not recoup any monies from you provided you have acted reasonably with us.
Having made the necessary enquiries to confirm that the motorist was untraced, we submit a claim on your behalf to the MIB. The MIB will confirm receipt of our application as soon as possible and investigate the matter further, before reaching a decision on whether to accept the claim. We will advise you all the way. The Motor Insurers Bureau normally obtain medical evidence if they are satisfied that a claim exists and provides an offer thereafter. We will ensure that your losses are fully quantified and advise you as to the suitability of any offers received. Where there seem to be the prospects of a long delay, the MIB will consider an interim payment.
