Extension of the Stay on Possession Proceedings

The current stay on possession proceedings has been extended to 23 August 2020.

The government have also announced that they are working with the judiciary to ensure that those who are shielding are properly protected.

Where does this leave landlords who want to evict their tenants? Where the property is subject to a mortgage, the mortgage companies should be extending the mortgage holidays in order to help landlords. You can still serve Notice on your tenants but up until 30th September the Notice is now 3 months, regardless of which grounds. Many landlords are  being encouraged to enter into dialogue with their tenants to see if a payment plan can be negotiated for rent arrears; or where tenants are on furlough, a reduction in rent to 80%.
