Small Claims Court

If you owe money to a person or company and have been unable to pay, they may take legal action and use the small claims procedure to recover the money from you.

The Small Claims Court refers to small claims (claims of up to £10,000) that go through the court system. You could be taken to court or bring a claim using the small claims procedure.  Claims can be by individuals or companies.

Often, the first time you will be aware that action is being taken against you is when you receive a claim form stamped by the court. This could be delivered in the post or be given to you in person. It’s important not to ignore the form; if you do, decisions could be made in court without you having the opportunity to put your case forward. If you have received a claim form, you may wish to seek legal advice about the best way to proceed.
