Italian will did not impliedly revoke earlier English will (Court of Appeal)

The Court of Appeal has upheld the High Court's decision that an Italian will did not impliedly revoke an earlier English will under English law. In reaching its decision, the Court of Appeal rejected the argument that the presumption that the construction of the Italian will should be governed by the law of the testator's domicile (English law) was rebutted by circumstantial evidence that the testator had intended Italian law to apply. (Curati v Perdoni and another [2012] EWCA Civ 1381.)
