Supreme Court Judgment
Lynn Shellfish and others v Loose and another [2016] UKSC 14

On appeal from [2014] EWCA Civ 846

Statement issued by QualitySolicitors Parkinson Wright on behalf of John Loose (Respondent)

“Our client is pleased that the Supreme Court has upheld the fishery out as far as Lowest Astronomical Tide, which will protect against poachers in the areas where the most important stocks of cockles and mussels are to be found.  This claim was brought as a result of intrusions onto the private fishery, and almost all those intrusions were in areas which are now established to be part of the private fishery.  As for the decision on detached sandbanks, the implications of this are yet to be worked out, but it is not expected that this will have a significant impact on the fishery.”
