Purposes of processing your personal data and how your data is used

The firm will only request necessary information to progress your case, and the data will only be used in a way you would reasonably expect. Your data will never be passed onto any other companies for marketing purposes or overseas. Your information may be disclosed, if we are legally required to do so, to regulatory bodies or law enforcement agencies for the purposes of crime prevention, compliance monitoring or enforcement.  We will always explain transparently to you, the reason we are requesting data and how the information will be used. The firm will always act with integrity and with your best interests in mind.

The mandatory information that we are required to collect is as follows: 

  • your full name/previous names;
  • current and previous addresses;
  • e-mail address;
  • telephone numbers;
  • date of birth;
  • identity documents such as a passport/driving licence;
  • utility bill and
  • any other relevant information to progress your case.

CCTV

Both our offices have CCTV in reception areas and the entrance to the building; this is for the protection of our Clients and Staff. All footage is stored by a reputable, trusted company and is only accessible by Partners of the Firm.

DPO (Data Protection Officer)

Third parties

Edward Hughes will never pass your information to any unnecessary third party. Any persons receiving your data will be purely for the progression of your case and the firm will always notify you of the persons receiving your data.

Retention

Your file will be retained by the firm for 6 years, or 12 years depending on the type of work carried out and, in certain circumstances, off-site with a reputable, trusted company, upon the settlement of your case, in accordance with the SRA rules and regulations.

How we keep your data secure

We are under a general duty to keep your personal data confidential and secure. We use secure protocols to protect your personal data.

Your rights

All requests must be made in writing to Jane Watson and the firm will respond without delay. You have the right to request access to the following information :

  • Personal data we hold, and on what basis;
  • To correct any inaccuracies in the data;
  • You may request that we erase personal data (if the firm is not entitled, under law, to process it or it is no longer necessary to process it);
  • Apply for data to be restricted whilst any amendments are made/objections settled;
  • The right to be notified of any security breaches concerning personal data;
  • The right to object (please note, if you refuse to provide relevant information, it may implicate the firm being able to act for you);
  • We will not charge a fee for any of the above requests, unless it is found excessive or repetitive;
  • The firm may reject any request; however, we will inform you immediately of the reasons why the request is being rejected. You have the right to refer your request to the ICO (Information Commissioner’s Office) who will investigate the matter further.

If you have any concerns regarding your data, you may contact Jane Watson (DPO), or Mr David Jones (Senior Partner). The ICO (Information Commissioners Office) has further information regarding your rights and our obligations, on their website www.ico.org.uk. You also may complain to the Information Commissioner’s Office directly.
