Dissolving a Civil Partnership
The court will need to see reasons for ending your partnership, this is supported by facts, i.e; unreasonable behaviour, desertion, living separately for more than two years. Once these facts are decided, you need to complete a 'Dissolution Petition' form and send it to the court. Upon receipt the court will send a copy to your partner, including another form called an 'Acknowledgement of Service' of which your partner will need to complete and return within a timeframe. They will also notify you by sending you a document called 'Notice of Issue of Petition' this informs you the date that they have sent the forms to your partner.
If you are sent a Dissolution Petition
If you have received a Dissolution Petition form this means that your partner has started the process of a civil separation. You will also have received an ‘Acknowledgement of Service’ form. This form will need to be completed to show whether you agree or contest the petition. By agreeing you accept the grounds for separation the process may be started to gain a 'Conditional Order'. What is a Conditional Order..?
This is a document that says the court doesn’t see any reason why you can’t dissolve the civil partnership. To apply for this document you will need to prove your partner has agreed to the dissolution petition, this will be stated on 'Acknowledgent of Service' form your partner would have completed and sent to the courts. You will also be asked to complete two other forms a 'Application for a Conditional Order’ and a form 'Affidavit of in support of the petition'. Both of which our solicitor will help you with.
Getting a Final Order to Dissolve your Partnership
Before you can apply for a final order, you must already have a Conditional Order from the court. You will need to complete form ‘Notice of application for conditional order to be made final’.
Receiving the Final Order
The court will make checks on the information provided and if the court is happy with the information, it will send you and your civil partner a final order document. This means your civil partnership has ended and you can now enter into another civil partnership if you should wish.
