When someone dies whilst being cared for by police officers or prison guards, they are classed as being under the ‘care of the state’. This means that an Inquest must not only carry out its normal duties, it must also investigate whether the deceased person’s ‘right to life’ has been breached because those responsible have failed to protect them.

You may hear this referred to as an Article 2 Inquest – these are usually carried out in front of a jury and must examine in detail the circumstances surrounding the death.
