The Defendant was involved in a head on collision with another vehicle in which the other driver was tragically killed at the scene. In this case the Crown alleged that the rear tyres of the Defendant’s vehicle were under-inflated by 7psi ie about 23 % below the recommended tyre pressures.
The Defendant had been driving within the speed limit for the road in question but the Crown alleged that it was an excessive speed for the road conditions at the time.
The accident happened on a very cold December night & there were issues as to whether black ice had formed on the carriageway & whether the Council’s salting procedures were adequate.
The Magistrates Court found that the case was sufficiently serious to commit the Defendant to the Crown Court for trial by judge and jury.
In preparing our client’s defence, we commissioned a report from an independent road traffic collision investigator & from a highways expert. The evidence revealed that the number of accidents at this location were appreciably higher than the national average.
Following a 5 day trial in the Crown Court our client was very relieved to be acquitted by a unanimous decision of the jury.
