Matrimonial financial matters are dealt with separately to the divorce proceedings, and a court application for a financial order may become necessary in circumstances when the parties are unable to reach an agreement. Financial applications can be expensive and parties are encouraged to attempt a settlement through negotiations with the exchange of financial information. This can be achieved using experienced solicitors or alternatively through mediation.
Our fees for Financial Order applications at court are fixed fee and start from £500+VAT with the additional court fee of £255.00. You may qualify for a court fee exemption depending on your monthly income and amount of your savings. When parties are able to reach a settlement of their matrimonial finances, a Consent Order should be drafted by a solicitor and submitted to the family court for approval. The court will decide whether it is a fair settlement according to the individual circumstances.
Our charges for a no asset Clean Break Consent are from £300 plus VAT, and for Clean Break Order with assets our charges start from £450 plus VAT. The court fee is £50.00 and can be shared.
