Need to Know More?

A Lasting Power of Attorney or LPA is a document that states a person, or persons, may either act out your decisions on your behalf or make decisions for you should you be unable to do so. Those you appoint as LPA's are referred to as donee's and, as the subject of an LPA, you are referred to as the donor.

There are two types of LPA; a Health and Care LPA, who looks after your health, treatment and living arrangements should you become mentally incapable of doing so yourself and a Property and Financial LPA. The latter can be limited to only being able to act when you are mentally incapacitated or used for other scenarios, such as when you are ill, physically incapacitated or when you are abroad.

A Lasting Power of Attorney can only be appointed when you are capable so it is not something you can leave until such time as you need it. In order to ascertain that you are capable and in sound mind, you (as the donor) must appoint either someone who has known you personally for at least two years or a qualified professional to sign an LPA certificate confirming that you are of full mental capacity. Family members and other exclusions apply to who can sign this certificate for you.
