What exactly is conveyancing?

This March is National Conveyancing Month, so for our latest blog it’s time to dive into what our conveyancing team does and why it’s so important to the home-buying or selling process.

The basics

Ever wondered what happens behind the scenes when buying or selling a property? A conveyancer takes care of everything from legal checks to contracts, ensuring your transaction is secure and hassle-free.

Conveyancing is the legal process involved when a property passes from a seller to a buyer. This process starts as soon as an offer is accepted on a property and lasts until the buyer collects their keys and the conveyancer registers the property in the name of the buyer at the Land Registry.

So, what does a conveyancer do?

During the conveyancing journey, a conveyancer’s job is to action important legal tasks including:

  • Checking property titles & legal documents

There’s a lot of paperwork that comes with all aspects of property ownership and much of the conveyancing journey involves meticulously going through these documents to ensure everything is correct and then amending it to reflect the new ownership.

  • Handling contracts & negotiations

It’s up to the seller’s solicitor to draft a contract and provide the buyer’s solicitor with all relevant details and documents regarding the property in question. At this stage, there are a lot of back-and-forth queries and answers between the buyer and the seller’s conveyancing teams.

  • Property Searches and Stamp Duty

Conveyancing searches are an important part of the due diligence process we go through on behalf of our clients looking to buy property. They help protect your investment by highlighting any unforeseen potential issues with your property.

Stamp Duty is also a key consideration, making sure you pay the right value of Stamp Duty land tax as a purchaser, based on the property price.

  • Ensuring a smooth exchange of contracts, funds & completion

For most clients, this is the most important bit! Conveyancers help make sure that sales and purchases go through smoothly, by tying up all the loose ends, meaning that you can finally move in, or out, of your property.
