Following the passing of a loved one, all assets and debts that are held in their name have to be valued as at the date of death and the Executor or Executors will need to determine whether any Inheritance Tax is payable to HMRC. Once all taxes and liabilities have been settled, the estate can then be distributed in accordance with the terms of the Will. It is also important to note that without a Will in place, the estate will be distributed under the law of Intestacy (our team can advise further on this).

What is a Grant of Probate, and do I need one?

One important job after someone dies is for the person named in the Will as the "Executor" to apply for something called a Grant of Probate. This is like a legal document that lets the Executor handle the Estate properly. Without a Grant of Probate, it's tricky for the Executor to do their job, and it can make things difficult for anyone trying to help with the Estate. It is only possible to apply for the Grant of Probate once an Inheritance Tax return has been submitted to HMRC if the estate is a taxable one.
