What are bereavement damages?

‘Bereavement damages’ is the payment fixed by law for the grief and trauma suffered when someone dies due to the actions of someone else.

It is currently a fixed amount but it is important to know it is only available to a very limited number. Your exact situation will need to be looked at but it is usually limited to the husband or wife or Civil Partner. There are other possible circumstances to be aware of;

  • If you were an unmarried couple and were together for more than two years you should be able to claim under the Human Rights Act
  • Where the person who has died is under eighteen years of age – and they are not married – then a parent may receive any bereavement payment
