What is the time limit for bringing an accident and injury claim?

However the general rule is that for adults you have three years from the date of the injury to have either settled the claim or started court proceedings.

This differs if;

  • It is an injury in connection with an assault or travel by air or sea – the deadline is two years
  • It is an accident abroad the ‘local’ laws apply - which can be as little as six months
  • Children are involved, it is often different - their deadline can be extended until their 21st birthday
  • Exceptional circumstances apply – in some very limited circumstances the time limit can be extended by the court
