Ah, good old prescriptive rights. The source of much work for property litigation/disputes lawyers. The approach taken is now clear that there is much a landowner can do to protect their position. Do you have a property which includes a car park? Do you know who is parking there? Perhaps you have no idea who is using it and never bothered about it before. Now what are you going to do about it?

When buying a house together, one of the fundamental things that might slip your mind amongst saving for the deposit, applying for the mortgage or deciding which tiles to have in the downstairs loo, might be how you will actually hold the property together. There are two ways to legally own a property, as Joint Tenants and or as Tenants in Common.
