Can I still bring my road traffic accident claim if the other driver was not insured?

Yes you can.

To make a successful claim we start by tracking down the details of the other driver's vehicle and motor insurance via the Department of Transport and DVLA's centralised records. If it turns out there is no insurance we will then make your claim under the special rules that apply to the Motor Insurers' Bureau Uninsured Drivers' Scheme. Simply this means that you will still receive the compensation you are entitled to – all we need to do is comply with the special rules applicable to your claim which we can advise you on.

And if it turns out you are the passenger in an uninsured car - we may be able to help you prove that you were unaware that the car you were in was uninsured at the time.
