Can you help with my claim for flight and lost luggage problems?

Most airlines and tour operators particularly in the European Union (or EU) are obliged to have schemes that provide compensation if your flight has been significantly delayed or cancelled.

The starting point is to complain to the airline or tour operator responsible and ask for a copy of their compensation scheme. This sets out what you are entitled to – it should include details about a full refund or alternative flights, any refreshments or accommodation as well as any compensation for the inconvenience of the delay.

It should also set out when payments will not made - for example with extreme weather conditions or major security problems.

Regarding your luggage if that fails to arrive the compulsory scheme that applies is usually not generous. It tends to be limited to the cost of spending on ‘essential items’ until your belongings arrive. Even if your luggage is completely lost there is a limit on the amount they are obliged to pay.

You can refer to the Small Claims Court if you do not feel you have received fair treatment - sometimes this ‘persuades’ airlines or tour operators to behave more reasonably.
