What time limit applies to bringing a holiday accident claim?
This varies from country to country and can be as short as six months – but this is a complex area of law so it is important for you to take early legal advice to help you decide what to do next.
If you were on a package holiday booked with a tour operator in the UK there may be a longer time period. It does depend on what the injury is and how it happened i.e. did it happen at the hotel complex, during a trip booked before you left the UK or on the transfer from the airport to the hotel? If so, it is the tour operator that is liable and under the rules that apply in England and Wales, you have three years to bring your claim or up to the 21st birthday of a child. However the time period is reduced to two years if the injury occurs in connection with travel by air or at sea – as we said this is complex, so you need to speak to one of our specialists who will discuss your situation.
