I am reading this abroad, are there things I should do now to help my holiday accident or illness claim?
You have already done the best thing you can do – and that is to start preparing your evidence. The next step is to use our ‘Contact us’ form so that one of our specialist lawyers can give you specific advice whilst you are still on holiday. The first time you talk to one of our legal experts is free.
In terms of general advice, here is a list of the main actions to take or think about:
- Take photographs or video evidence showing what you think caused you to be ill or to injure yourself.
- Take the contact details of anyone who saw what happened to you.
- Take the details of anyone else who may have suffered the same as you – if others have suffered too, it makes your claim a stronger one.
- Make sure you have the appropriate medical treatment and keep a note of who treated you and where it was provided- it may be to the hotel or to your holiday ‘rep’ but keep a note of when and to whom you reported it, maybe get them to sign something or ask for a written report form.
- Keep a list of any expenses you incur because of your injury or illness i.e. taxi fares to hospital or medication.
- Keep a record or a diary of the pain and suffering you endure and what impact it has on your holiday.
There are also some ‘do not do’ tips - things you shouldn’t do.
- Firstly, do not feel pressurised into accepting that you were to blame for what happened
- And do not accept any offer of money or apology in kind (like a free meal or drinks) without. speaking to us. This may be seen as you having accepted something ‘in full and final settlement’ and could prevent you from claiming what you are actually entitled to.
