Can you help me apply to the Court of Protection so I can make decisions on behalf of the person who has lost capacity?

What we would do is apply for you to be what is called a Deputy. If granted you then have responsibility for making decisions on their behalf. With more complex situations you can apply for a trusted solicitor to carry out this role for you. If there is no suitable Deputy, the Court of Protection will appoint a lawyer from their panel.

The process that follows is the court will be looking for evidence that your loved one lacks the capacity to make certain decisions for themselves – this is supported by a medical professional providing a ‘Capacity Report’ after which the application can proceed.
