Living Together: Is the Law Finally Catching Up?

If you’re living with your partner but haven't tied the knot, you’ve probably heard the term ‘common law marriage.’ It’s a phrase that gets thrown around a lot, usually with the assumption that after a few years of sharing a kettle and a mortgage, you have the same legal rights as a married couple.

The truth? In the eyes of the law, ‘common law marriage’ doesn't actually exist.

Right now, if an unmarried couple splits up or one partner passes away without a Will, the legal fallout can be devastating. We’ve seen cases where people are left with nothing simply because they weren't married—regardless of how many decades they spent together.

Big Changes on the Horizon

There is some good news, though. The government has just launched a major consultation aimed at fixing these "archaic" rules. The goal is to give cohabiting couples the financial safety net they’ve been missing for years.

  • Under the new proposals, couples who have lived together for at least three years (or who have a child together) could soon see some significant changes:
  • Automatic Inheritance: Currently, if your partner dies without a Will, you don't automatically inherit anything. These reforms want to change that.
  • Financial Protection: Breaking up is hard enough without having to worry about being left destitute. The new rules would offer greater financial protection when a relationship ends.
  • Legal Nuptials: The government is also looking at making pre- and post-nuptial agreements legally binding, giving everyone more certainty from the start.

Why This Matters Now

Times are changing. Fewer people are choosing to marry, and more than half of children in the UK are now born to unmarried parents. The law needs to reflect how we actually live today, not how things were fifty years ago.

Whether you’ve escaped a difficult situation or you’re just looking for some stability for your family’s future, these reforms are a huge step in the right direction.

What Should You Do in the Meantime?

While we wait for the law to catch up, you don't have to leave your future to chance. Whether it’s drafting a cohabitation agreement or making sure your Will is up to date, there are plenty of ways to protect what matters most to you right now.
