What if the suspicious death happened to a patient in hospital?

The answer depends.

If the individual is in hospital of their own free will then the usual Inquest rules apply.

However, if the individual was ‘made’ to be in hospital i.e. they were detained or ‘sectioned’ under the Mental Health Act, any Inquest must investigate whether the deceased person’s ‘right to life’ has been breached. This means that those responsible for their care failed to protect them.

You may hear this referred to as an Article 2 Inquest – these are usually carried out in front of a jury and must examine in detail the circumstances surrounding the death.
