Can you go on holiday when on sick leave?

An employee can use their paid holiday (annual leave) while off sick for the following reasons:
  • They are not physically able to work, but physically able to go on holiday
  • They have a mental health condition that might be improved by a holiday
  • They are off sick long term and a holiday might improve their health

Your employee cannot force you to take holiday leave; it’s up to you to request holiday. If necessary, the sick leave can be paused while your holiday leave takes effect and then resumed on your return.
