Following our bulletin on the 26th July regarding the abolition of fees in the employment tribunal, we have today been informed that the Government is still committed to the repayment of fees for those who paid them under the now deemed unlawful regime.  We understand that the Government is committed to working on “a process that is as simple and as unobtrusive as possible for those who make an application, while ensuring that refunds are only paid to those who are entitled.” They have stated that they need to iron out a few issues  including, for example, how to deal with refunds in claims involving multiple claimants, and how it will operate when the tribunal has ordered the opposing party to reimburse a fee.

We further understand that details of the refund scheme will be published some time in September.
